What exactly is an ITIN number and do I even need to apply for one? I’ll answer that question for you right after the intro. Welcome back to our channel. Today I’m going to cover a frequently asked question and that is, do I need an ITIN number? And the follow-up question is, how can I get an ITIN? But first, what exactly is an ITIN anyways? An ITIN is an acronym and it stands for Individual Taxpayer Identification Number.
And it’s a number that’s issued by the IRS to people who have a tax filing requirement here in the United States, but that are otherwise not eligible to get a social security number. So here’s how you can determine if you need an ITIN number. Okay, so listen up.
You’re going to need an ITIN if you need to file a U.S. tax return. For example, you might have had U.S. source income subject to tax. For example, rental income, investment income, or wages where withholding isn’t sufficient.
Number two would be that number one applies, but you’re not eligible for a social security number. Typically, this includes people that are non-resident aliens or resident aliens that are residents based on the substantial presence test or other criteria and their dependents or spouses. Number three, you are claimed as a dependent or a spouse on someone else’s U.S. tax return. Dependents and spouses without a social security number might want to get an ITIN because it may benefit the whole tax filing scenario. Number four is that you have a filing requirement and want to claim treaty benefits.
So you have to file a tax return for that and you will need an ITIN for that. Number five is that you’re a foreign national with U.S. financial dealings. An ITIN is oftentimes required, not always, but oftentimes, for foreign individuals who have income investments in the United States, such as bank accounts or investments that are subject to a tax.
Number six, you are a member of a partnership or owner of a corporation that needs your ITIN for tax reporting. As a member or owner of a U.S. company, there’s going to be money that will eventually be earned by you and that you’re going to have to claim on your tax return. And for that, again, you need an ITIN number.
So when do you not need an ITIN number? If you are eligible for a social security number, then you don’t have to apply for an ITIN number. You’re going to get the social security number instead. Another reason why you don’t need it is if you’re filing form 8843, such as if you’re a student or exchange visitor who is exempt from U.S. taxes based on your status and other reasons.
Another reason you don’t need one is if you don’t have a U.S. tax filing reporting obligation. OK, so you’ve determined that you do need an ITIN number. So how do you go about getting one? There are two ways to get one.
One is by means of filing a 1040NR or 1040. And the other is via the LLC that you’re a member of. In both cases, you’re going to need to complete a Form W-7, which is the application for the ITIN number.
You’re going to have to provide supporting documents, such as your passport. And you’re going to have to submit the application. You can do the application in person.
You could do it by mailing it to the IRS, or you can do it through a certified acceptance agent. Here in Freedom Group, we have licensed CAAs or certified acceptance agents. And this is really important.
Why? Because that passport you’re going to need to provide will either need to be physically mailed to the IRS, where they will take their time to process the application and then hopefully mail it back to you in a few months. And hopefully it doesn’t get lost in transit to you. Or you can get the copy of it certified by a CAA and have that copy mailed in with the application.
